In cases where multiple candidates have the same lowest score, the tie-breaking rule is based on the date and time of their Express Entry profile submission.
1. Definitions:
Act: The Immigration and Refugee Protection Act.
Eligible foreign national: A foreign national whose expression of interest is in the express entry pool established by the Express Entry Instructions.
Express Entry Instructions: The Ministerial Instructions Respecting the Express Entry System, as published in the Canada Gazette, Part I, on December 1, 2014, and as amended from time to time.
Full-time work: Work that has the same meaning as in subsection 73(1) of the Regulations.
Group ranking: The ranking established among the eligible foreign nationals of whom the grouping established in section 5 consists.
Invitation: Same meaning as in section 1 of the Express Entry Instructions.
National Occupational Classification: Same meaning as in section 2 of the Regulations.
Regulations: The Immigration and Refugee Protection Regulations.
Work: Same meaning as in subsection 73(2) of the Regulations.
Category:
- The Healthcare occupations (2023-1) category is established for the purposes of ranking, as specified in section 7.
Member of category:
3(1) An eligible foreign national is a member of the category established in section 2 if they are not a member of the class referred to in paragraph 2(d) of the Express Entry Instructions and if they meet the following requirements:
- Within the three-year period preceding the establishment of the category, they have accumulated at least six months of full-time work experience, or the equivalent in part-time work, in one of the occupations listed in the table of this section.
- During that period of work experience, they performed the actions described in the lead statement for the occupation as set out in the occupational descriptions of the National Occupational Classification.
- During that period of work experience, they performed a substantial number of the main duties of the occupation as set out in the occupational descriptions of the National Occupational Classification, including all of the essential duties.
(2) An eligible foreign national is not a member of the category established in section 2 if the work experience described in paragraphs (1)(a) to (c) was not accumulated within the three-year period preceding the date the officer receives their application for permanent residence.

4. When calculating a period of work experience, any unauthorized work in Canada should not be included.
Grouping:
5. To determine the ranking, a grouping of eligible foreign nationals is established, consisting of those who are eligible to be members of the category established in Section 2.
Economic goal:
6. The establishment of the category in section 2 aims to contribute to Canada’s long-term economic success by enhancing the responsiveness of federal skilled immigration to the labor market.

7. Invitations may be issued under these Ministerial Instructions from June 28, 2023, to June 29, 2023.

8. A total of 500 invitations may be issued to eligible foreign nationals in the established grouping in section 5.
