The 4 Steps To Get A Canada Temporary Work Permit

The Labour Market Impact Assessment (LMIA) Certificate is a document issued by the ESDC. A positive LMIA will be granted to your employer by the ESDC if and only if they are convinced that no Canadian or Permanent Resident can do the job that you are being offered. Once the employer gets a positive LMIA, they must send it to the foreign worker for him/her to include it in their work permit application.

An LMIA is not necessary to issue work permits for certain jobs and under few specific conditions – List of jobs which do not require LMIA.

The LMIA application for Quebec province is slightly different.

Once the positive LMIA certificate is obtained, the employer must send the temporary job offer to the foreign worker applicant. The temporary job offer document must also be attached to the work permit application (along with the LMIA) and should prove;

  • The genuineness of the job offer
  • That the wages and working conditions are high enough to equally appeal to Canadian workers
  • It is full-time employment and not seasonal

The offer letter should be a thoroughly professional document that must also include;

  • The job title
  • Description of job and responsibilities
  • Job requirement; Education, Work Experience, Skills, Licences etc.
  • Salary structure and payout details
  • Employee name and address
  • Address of the worker’s intended workplace

Note: If you are applying for an open work permit, then no need to provide a written job offer along with your application.

Apart from a positive LMIA certificate and Job offer document, other required documents for the Canada Temporary Work Permit application are;

  1. A valid passport
  2. Two photos of the applicant and accompanying family members

  4. Evidence of meeting the job requirements
  5. Proof of relationship with accompanying spouse, children
  6. Completed Application For Work Permit Made Outside of Canada form, if applying from outside Canada
  7. Completed Document Checklist

These documents need to be submitted to the Employment and Social Development Canada (ESDC)

If your job is in the province of Quebec, then you may also need to obtain the Certificat d’Acceptation du Quebec (CAQ) in order to work temporarily in Quebec.

Note: The submitted documents should be in English, French, and Spanish. If your documents are in any other language then they must be submitted along with a certified translation of the same.

Finally, after completing all the procedures correctly and submitting the required documents to the satisfaction of the ESDC, you’ll receive the Canada Temporary Work Permit. The permit will be issued by the Canada Border Services Agency (CBSA) at the point of entry when you arrive in Canada.

There are 2 types of Canada Temporary Work Permits

This is the most common work permit which foreign workers apply. An Employer Specific Work Permit allows you to work in Canada for a specific employer. The temporary work visa is tied to the company you are going to work in. If you are planning to change employer, then you must apply for a new Temporary Work Visa based on the new employer.

An Open Work Permit allows you to work for any employer in Canada for a fixed period of time. It lets you enter Canada without any job offer. It does not restrict you to just one employer. However, an Open Work Permit may restrict the type of occupation you can take up and the location in Canada where you can take it up.

The Duration of a Canada Temporary Work Permit may be from a few days to a few years based on the type of job you are going to do and the contract with your employer in Canada.

Note: Open work permits can only be issued to accompanying spouses, common-law partners, and dependent children.

Before applying, it is important to receive a written job offer letter from the employer in Canada.
